COURSE TERMS AND CONDITIONS

 1.          Definitions

1.1.     When the following words with capital letters are used in these Terms, this is what they will mean:

Course: any course providing tuition and instruction provided by Us and Courses will be construed accordingly.

Event Outside Our Control: any act or event beyond Our reasonable control, including without limitation injury or illness of a Course host, speaker or provider, strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks.

Terms:the terms and conditions set out in this document.

We/Our/Us: Retro from Scratch 

2.          Our Right to Cancel a Course

2.1.     We may cancel a Course at any time by providing you with at least 28 calendar days' notice in writing.

2.2.     We may have to cancel a Course at any time if:

2.2.1.there is an Event Outside Our Control; or

2.2.2.the date of the Course is 10 days or less there are less than 4 delegates booked on a Course and; or

2.2.3.the venue, key personnel (including, without limitation, because of injury or ill health) or key materials are rendered unavailable and without which We cannot provide theCourse.

2.3.     If we cancel a booking in accordance with clause 2.1 or any of the events specified in clause 2.2. happen:

2.3.1.We will promptly contact you to let you know;

2.3.2.if you have made a payment in advance you have the option of either:

2.3.2.1.   booking another Course on a different date; or

2.3.2.2.   We will refund any amounts already paid by you; and

2.4.     We may cancel a Course at any time with immediate effect if:

2.4.1.you do not pay Us when you are supposed to; or

2.4.2.you break the contract in any other material way and you do not correct or fix the situation within 5 days of Us asking you to do so in writing.

2.5.     In the event that we cancel any Course in accordance with our rights set out above we will not be liable to you in any way with regard to paying for or contributing to any costs, expenses or other monies spent by you in preparation for your attendance at a Course such as, for example only, travel expenses or the purchase of materials for use at a Course.

2.6.     Any refunds will be made to the credit card or debit card which was used to pay. 

3.          Your Right to Cancel a Course

3.1.     Before you have attended a Course, you have the following rights to cancel

3.1.1.you may cancel a Course at any time however the following cancellation charges will apply:

3.1.1.1.   over 30 days from the date on which the Course is due to start – full refund of any payment made in advance and the option to book another Course on a different date (up to a maximum of 2 re-booking allowed otherwise a charge of 100% of the cost of the Course will be charged);

3.1.1.2.   15-29 days from the date on which the Course is due to start – 30% of the cost of the Course will be charged if you choose to book a Course on another date.  There will be no refund available for non-attendance;

3.1.1.3.   Within 14 days from the date on which the Course is due to start – 50% of the cost of the Course will be charged if you choose to book a Course on another date.  There will be no refund available for non-attendance; and

3.1.1.4.   within 3 days or ‘no-show’ – 100% of the cost of the Course will be charged if you choose to book a Course on another date.  There will be no refund available for non-attendance.

3.1.2.        Subject to clause 3.1.3. in order to cancel in accordance with clause 3.1.1.  you must contact us by email at retrofromscratch@live.co.uk which we will confirm the terms of your cancellation in writing.

3.1.3.        If you cancel a Course for any of the reasons set out in clause 3.1.1 and we have already incurred any costs in respect of that booking, in addition to any cancellation charges payable under clause 3.1.1. you agree to pay us any costs we reasonably incurred and this charge will be deducted from any refund that is due to you or, if no refund is due to you, invoiced to you.  We will tell you what these costs are when we confirm the terms of your cancellation.

3.2.     If, before a Course has taken place, We are affected by an Event Outside of Our Control, you may cancel a course by contacting us by email at retrofromscratch@live.co.uk or by telephone (and confirmed in writing) on 07968 395768.  If you have made any payment in advance, We will refund these amounts to you. 

3.3.     Any refunds will be made to the credit card or debit card used by you to pay. If you used vouchers to pay for the Product we may refund you in vouchers.

4.          Events Outside Our Control

4.1.     We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms that is caused by an Event Outside Our Control.

4.2.     If an Event Outside Our Control takes place that affects the performance of our obligations under these Terms:

4.2.1.        We will contact you as soon as reasonably possible to notify you; and

4.2.2.        Our obligation to provide the Course will be suspended and the time for performance of Our obligations will be extended for the duration of the Event Outside Our Control.  Where the Event Outside Our Control affects Our performance ofa Course, We will use reasonable endeavours to provide an alternative course date as soon as reasonably possible after the Event Outside Our Control is over.

4.3.     You may cancel the Course if an Event Outside Our Control takes place and you no longer wish to take a place on a Course.  Please see yourcancellation rights under clause 3.2. 

4.4.     We will only cancel the Course if the Event Outside Our Control continues for longer than 4 weeks in accordance with Our cancellation rights in clause 2.2.1.

5.          Confidentiality

You hereby agree that:

5.1.     you will not without Our prior written approval video or use any other similar recording device to record any part of the Course;

5.2.     in the event that you are given prior written approval in accordance with clause 5.1. you will not make available to the public or any other party or parties any of the Recorded Material without Our prior written approval after providing Us with details of how the Recorded Material will be made available;

5.3.     you will accord us credit on any use or reproduction of the Recorded Material as We may permit should we so request and will provide contractually in agreements with all other parties who display the Materials  that they will accord us the same credit;

5.4.     you will keep in strict confidence all technical or commercial know-how, specifications, inventions, processes or initiatives which are of a confidential nature and have been disclosed to you by Us or which you may become privy to by reason of your attendance on a Course.  You will only disclose such confidential information as is required to be disclosed by law, any governmental or regulatory authority or by a court of competent jurisdiction.

 

6.          Our Right to Vary these Terms

We may vary these Terms from time to time so please check these terms each and every time you place a booking for a Course as the Terms in force at the time of your order will apply to the contract between you and Retro from Scratch TERMS AND CONDITIONS
